As an independent travel company, we take pride in providing honest advice, personal service and exceptional attention to detail. These Booking Conditions have been written to explain our responsibilities clearly and help you book with confidence.

‍Whether we are arranging a holiday as your Travel Agent or creating a tailor-made itinerary as your Tour Organiser, our commitment remains the same: to understand your travel plans, explain your options clearly and help you make informed decisions every step of the way.

At Kukula Travel, we believe exceptional travel is about far more than simply reaching a destination. These Booking Conditions explain the basis upon which we arrange your travel and form the agreement between you and Kukula Travel Ltd.

‍Because we offer different types of travel arrangements, it is important that you understand the role we are performing for your booking.

Depending on the holiday you choose, Kukula Travel Ltd may act either as:

  • your Travel Agent, arranging travel services provided by another tour operator, airline, cruise line or travel supplier; or

  • your Tour Organiser, creating and organising your holiday under the Kukula Travel brand.

‍ ‍Your Booking Confirmation will always confirm which role applies. This is important because it determines who your contract is with, who is responsible for providing your travel arrangements and which booking conditions apply.

If there is anything within these Booking Conditions that you do not understand, please ask us before confirming your booking. We will always be happy to explain any aspect of your holiday arrangements.

Kukula Travel Ltd is a member of the Travel Trust Association (TTA) (Membership No. X4450). Bookings benefit from financial protection through the TTA Trust Account arrangements and, where applicable, the Stand Alone Safe Seat Plan Guarantee (SASSPG). Where your booking includes flights protected by another ATOL holder, the relevant ATOL holder's protection will apply.

‍Key Terms Used in These Booking Conditions

To help make these Booking Conditions easier to read:

·        Lead Passenger means the person who makes the booking on behalf of everyone travelling.

·        Travel Agent means Kukula Travel Ltd arranging travel on behalf of another travel supplier or Tour Organiser.

·        Tour Organiser means Kukula Travel Ltd creating and organising your holiday.

·        Booking Confirmation means the written confirmation we issue when your booking is accepted.

·        Supplier means the airline, accommodation provider, transport company, activity provider or other organisation providing your travel services.

2. Our Role

‍ ‍

Because Kukula Travel provides different types of travel arrangements, our legal responsibilities vary depending on the services you book.

We will always make our role clear before you confirm your booking.

‍When we act as your Travel Agent

‍Where we arrange travel services on behalf of another tour operator, airline, cruise company, accommodation provider or other travel supplier, Kukula Travel Ltd acts solely as your Travel Agent.

‍In these circumstances:

  • your contract is with the relevant supplier or tour operator;

  • the supplier's own booking conditions apply in addition to these Booking Conditions where relevant;

  • responsibility for providing the booked travel arrangements rests with that supplier;

  • any applicable financial protection, including ATOL protection where relevant, will be provided by that supplier. Your booking will also benefit from the relevant TTA financial protection

‍Our responsibility is to arrange your booking with reasonable care and skill, provide accurate information supplied by the travel provider and assist you throughout the booking process.

When we act as your Tour Organiser

‍Where Kukula Travel creates and organises a package holiday in our own name, we act as the Tour Organiser.

‍In these circumstances:

  • your contract is with Kukula Travel Ltd;

  • we are responsible for the performance of the travel services included within your package in accordance with applicable legislation;

  • we will clearly identify ourselves as the organiser before your booking is confirmed;

  • Your booking will also benefit from TTA financial protection the financial protection and is explained in this documentation.

‍Whichever role we perform, we are committed to providing honest advice, excellent personal service and carefully planned holidays and journeys.

‍We work with trusted suppliers whom we believe share our commitment to quality, safety and responsible tourism. However, every destination is different, and travel arrangements may occasionally change due to operational requirements, weather, government action or other circumstances beyond anyone's control. Where this happens, we will always work with you and our suppliers to achieve the best possible outcome.

3. Making Your Booking

‍Whether Kukula Travel Ltd is acting as your Travel Agent or your Tour Organiser, a booking is only confirmed when we have accepted your booking request and issued a written Booking Confirmation.

‍Before your booking is confirmed, we will provide you with the key information relating to your holiday, including details of the travel arrangements, the total price, any applicable financial protection and, where relevant, the identity of the Tour Organiser or principal travel supplier.

‍By making a booking, the person named as the lead passenger confirms that:

  • they are at least 18 years of age;

  • they have the authority to make the booking on behalf of everyone travelling;

  • they have read and accepted these Booking Conditions on behalf of all members of the party;

  • they agree to provide all travellers with copies of any booking documentation and information that we send.

‍A contract comes into existence only when we issue our written Booking Confirmation and, where required, receive the appropriate deposit or full payment.

‍It is important that you carefully check all booking documentation as soon as you receive it. If you believe any detail is incorrect, please contact us immediately. Delays in reporting errors may limit the options available to correct them.

‍Important Information for Tailor-Made Holidays

‍Where Kukula Travel Ltd is acting as your Tour Organiser, we begin creating and securing your holiday as soon as your booking is confirmed. Depending on the arrangements included in your itinerary, this may involve making advance payments or entering into contractual commitments with accommodation providers, airlines, guides, transport providers and other suppliers, many of whom operate strict cancellation terms.

This means that some elements of your holiday may become non-refundable shortly after booking. Where this applies, we will make this clear before you confirm your booking, so that you understand any supplier cancellation terms that may apply.

‍Communicating with the Lead Passenger

To help keep your booking simple and ensure information is shared consistently, we will normally communicate with the Lead Passenger throughout the booking process.

‍We ask the Lead Passenger to share all booking confirmations, travel documents, updates and other important information with the rest of the travelling party. Unless we agree otherwise, we may rely on instructions and decisions given by the Lead Passenger on behalf of everyone included in the booking.

‍Special Requirements and Requests

‍If you or anyone travelling with you has any medical condition, reduced mobility, disability, dietary requirement or other special requirement that may affect your holiday, please let us know as early as possible, and ideally before you confirm your booking. This will help us work with our travel partners to ensure your holiday is planned as smoothly as possible.

‍We are also happy to pass on any special requests, such as preferred room locations, adjoining rooms, dietary preferences or seating requests, wherever these can be accommodated.

‍We'll always do our best to communicate your requirements and requests to the relevant suppliers. However, as many services are provided by independent travel partners, we cannot guarantee that every request will be available unless it has been specifically confirmed in writing.

‍If you're unsure whether something is important to mention, please just ask. We'll always be happy to discuss your requirements and advise you before you book

4. Prices and Payment

‍All prices are quoted in Pounds Sterling (£), unless otherwise stated.

‍Prices are based on the costs, exchange rates, taxes and charges known at the time your quotation is prepared. As many of our holidays are individually tailored, quotations are normally valid only for the period stated on the quotation.

‍No price is guaranteed until your booking has been confirmed in writing.

‍Where we are acting as your Travel Agent, prices are determined by the relevant supplier and may be subject to that supplier's own pricing policies and booking conditions.

‍Where we are acting as Tour Organiser, every effort is made to maintain the price quoted to you. However, in limited circumstances, changes in taxes, government charges or other costs outside our control may require a price adjustment where permitted by law. Should this become necessary, we will explain the reason for the change and your rights under the Package Travel and Linked Travel Arrangements Regulations 2018.

‍Customers paying from outside the United Kingdom should be aware that their bank or card provider may apply currency conversion rates, foreign transaction fees or other charges when processing international payments. These charges, where applicable, are determined by your bank or card provider and are separate from the amount charged by Kukula Travel Ltd.

‍Unless otherwise agreed, all refunds will be made in Pounds Sterling (£ GBP). Kukula Travel Ltd cannot accept responsibility for any differences resulting from exchange rate movements, bank charges or currency conversion applied by your payment provider. Any bank charges incurred in sending or receiving international payments are the responsibility of the customer unless otherwise agreed in writing.

‍Deposit

‍A deposit is normally required at the time of booking.

‍The amount of the deposit will depend upon the holiday arrangements being booked and the requirements of our suppliers. Some suppliers, airlines or specialist accommodation providers may require a higher deposit or full payment at the time of booking.

Your quotation and Booking Confirmation will clearly state the amount payable.

A booking cannot be confirmed until the required deposit has been received.

‍Balance of Payment

‍Unless otherwise advised in writing, the balance of your holiday cost must be paid no later than 12 weeks before departure.

‍Some holidays, scheduled flights, cruises, tailor-made itineraries or specialist arrangements may require an earlier balance payment. Where this applies, the due date will be confirmed at the time of booking.

If payment is not received by the due date, we reserve the right to treat your booking as cancelled and cancellation charges may apply.

‍We will always endeavour to remind you when your balance is due, but responsibility for ensuring payment is received by the due date remains with you.

‍Methods of Payment

‍We will advise you of the payment methods available at the time of booking.

‍As your booking benefits from TTA financial protection, payments must be made in accordance with the payment instructions provided by Kukula Travel Ltd. This helps ensure that your money receives the appropriate financial protection available for your booking.

‍ ‍

‍5. Financial Protection

‍Protecting your money is one of our highest priorities.

‍Kukula Travel Ltd is a member of the Travel Trust Association (TTA) (Membership No. X4450). Customer payments are protected through the TTA Trust Account and the Stand Alone Safe Seat Plan Guarantee (SASSPG), providing 100% financial protection in accordance with the TTA's protection arrangements.

‍Where your booking includes ATOL-protected flights, the relevant ATOL holder will provide the applicable ATOL protection. Your booking documentation will identify the ATOL holder and include the relevant ATOL Certificate where required.

‍Before you confirm your holiday, we will always explain the financial protection that applies to your booking and answer any questions you may have.

‍ ‍

‍ ‍

6. If You Wish to Make Changes to Your Booking

‍ ‍

We understand that plans can change, and we will always do our best to accommodate reasonable requests.

‍ ‍

If you wish to make any changes to your confirmed booking, please contact us as soon as possible. Whether changes can be made will depend on the nature of your booking, the notice given before departure and the policies of the relevant suppliers.

‍ ‍

Where Kukula Travel Ltd is acting as your Travel Agent, any amendment requests will be subject to the terms and conditions of the relevant travel provider. Additional charges imposed by airlines, tour operators, accommodation providers or other suppliers will be payable by you.

‍ ‍

Where Kukula Travel Ltd is acting as your Tour Organiser, we will make every reasonable effort to accommodate your request. However, we cannot guarantee that all requested changes will be possible.

‍ ‍

Changes requested after a booking has been confirmed may result in:

‍ ‍

  • amendment fees charged by suppliers;

  • additional administration charges;

  • increased travel costs;

  • cancellation charges where a change is treated as a cancellation by the supplier.

‍ ‍

Any additional costs will be explained to you before changes are confirmed.

‍ ‍

Certain arrangements, including scheduled airline tickets, special offers, cruises and some accommodation bookings, may not be amendable after confirmation.

‍ ‍

‍ ‍

7. If You Wish to Cancel Your Booking

‍ ‍

If you need to cancel your holiday, the lead passenger must notify Kukula Travel Ltd in writing as soon as possible. Your cancellation will take effect from the date we receive your written notification.

‍ ‍

Where We Act as Your Travel Agent

‍ ‍

If we are acting solely as your Travel Agent, cancellation charges will be determined by the relevant Tour Organiser, airline or travel supplier. These charges may be up to 100% of the total holiday cost from the time of booking, particularly where scheduled flights or non-refundable travel arrangements have been confirmed.

‍ ‍

We will advise you of the applicable cancellation charges and assist you in understanding the supplier's cancellation policy.

‍ ‍

‍ ‍

Where We Act as Your Tour Organiser

‍ ‍

Where Kukula Travel Ltd is acting as your Tour Organiser, we begin creating and securing your holiday as soon as your booking is confirmed.

‍ ‍

Depending on the arrangements included in your itinerary, this may involve making advance payments or entering into contractual commitments with accommodation providers, airlines, guides, transport providers and other suppliers, some of whom operate strict cancellation terms. This means that certain elements of your holiday may become non-refundable shortly after booking. Where this applies, we will make this clear before you confirm your booking so that you understand any supplier cancellation terms that may apply.

If you cancel your booking, the following cancellation charges will normally apply:

Loss of deposit plus any non-refundable costs already paid or committed to suppliers

84–57 days

50% of the total holiday price plus any non-refundable costs already paid or committed to suppliers

56–29 days

75% of the total holiday price plus any non-refundable costs already paid or committed to suppliers

28 days or less

100% of the total holiday price

‍ ‍

Where our actual costs and losses are lower than the cancellation charge shown above, we may reduce the amount payable accordingly.

‍ ‍

A breakdown of cancellation charges will be provided upon request.

‍ ‍

Certain travel arrangements carry stricter cancellation conditions because our suppliers require payment well in advance of travel. These may include, but are not limited to:

‍ ‍

  • safari lodges and camps;

  • specialist accommodation;

  • scheduled, domestic or regional flights;

  • charter flights;

  • conservation and wildlife permits;

  • specialist guides;

  • private vehicles and transfers;

  • tailor-made excursions and activities; and

  • other travel services secured specifically for your itinerary.

Where such supplier conditions apply, we will explain them before or at the time of booking wherever reasonably practicable.

‍ ‍

‍ ‍

8. If We Need to Change Your Holiday

‍ ‍

Travel arrangements are planned many months in advance and, on occasion, changes become necessary.

‍ ‍

Kukula Travel Ltd reserves the right to make changes to your holiday before departure where this is reasonably necessary.

‍ ‍

Most changes are minor and will have little or no effect on the enjoyment of your holiday. Examples of minor changes may include:

‍ ‍

  • changes to flight times;

  • substitution of accommodation with one of a similar standard;

  • changes to vehicle type;

  • changes to safari guides or local representatives;

  • alterations to the order of your itinerary where the overall holiday remains substantially the same or changes made in response to weather conditions, conservation requirements, local operational circumstances or similar events where the overall holiday remains substantially the same.

‍ ‍

Where Kukula Travel Ltd are acting as your Tour Organiser, if we need to make a significant change before departure, we will notify you as soon as reasonably possible and explain the options available to you under the Package Travel and Linked Travel Arrangements Regulations 2018.

‍ ‍

Depending on the circumstances, these options may include:

‍ ‍

  • accepting the proposed change;

  • accepting an alternative holiday where available;

  • receiving an appropriate refund where required by law.

‍ ‍

Where Kukula Travel Ltd are acting solely as your Travel Agent, any significant changes will be governed by the booking conditions of the relevant supplier. We will pass on information promptly and assist you in communicating with the supplier.

‍ ‍

‍ ‍

9. If We Need to Cancel Your Holiday

‍ ‍

On rare occasions it may become necessary for Kukula Travel Ltd to cancel a holiday before departure.

‍ ‍

Where we act as your Tour Organiser, we reserve the right to cancel your holiday if:

‍ ‍

  • the minimum number of participants required for the trip has not been reached (where applicable);

  • circumstances beyond our reasonable control make it impossible to operate the holiday safely or lawfully;

  • unavoidable and extraordinary circumstances prevent the holiday from taking place.

‍ ‍

If we need to cancel your holiday for reasons other than your failure to make payment or your breach of these Booking Conditions, you will be offered the options available under the Package Travel and Linked Travel Arrangements Regulations 2018, which may include:

‍ ‍

  • an alternative holiday (where available); or

  • a refund of monies paid.

‍ ‍

Where Kukula Travel Ltd is acting solely as your Travel Agent, cancellations by suppliers will be subject to the supplier's booking conditions. We will notify you promptly and assist you in understanding the options offered by the supplier.

‍ ‍

10. Unavoidable and Extraordinary Circumstances

‍ ‍

Sometimes events occur which are outside the reasonable control of everyone involved in providing travel services.

‍ ‍

These are known in law as Unavoidable and Extraordinary Circumstances and may include, but are not limited to:

‍ ‍

  • war or threat of war;

  • civil unrest;

  • terrorism or the threat of terrorism;

  • natural disasters;

  • severe weather;

  • wildfire;

  • flooding;

  • earthquakes;

  • epidemic or pandemic;

  • public health emergencies

  • government restrictions;

  • border closures;

  • industrial disputes affecting transport;

  • unavoidable technical or operational issues affecting transport providers.

‍ ‍

Where such circumstances affect your holiday, Kukula Travel Ltd and our suppliers will always seek practical and reasonable solutions.

‍ ‍

However, neither Kukula Travel Ltd nor our suppliers will be liable for delays, alterations, cancellations or failure to perform contractual obligations where these result directly from Unavoidable and Extraordinary Circumstances, except where your rights are protected under applicable legislation.

‍ ‍

We will always endeavour to keep you informed and provide assistance appropriate to the circumstances.

‍ ‍

‍ ‍

11. Travel Insurance

‍ ‍

We consider comprehensive travel insurance to be an essential part of every holiday.

‍ ‍

You are responsible for ensuring that all members of your travelling party have suitable travel insurance in place from the time your booking is confirmed.

‍ ‍

Your policy should provide adequate cover for, where appropriate:

‍ ‍

  • cancellation and curtailment;

  • medical expenses and emergency treatment;

  • repatriation;

  • personal belongings and baggage;

  • personal liability;

  • travel delay and disruption;

  • legal expenses; and

  • any activities you intend to undertake during your holiday.

‍ ‍

It is your responsibility to ensure that your insurance policy is appropriate for your individual circumstances, including any pre-existing medical conditions, your destination and the activities you plan to participate in.

‍ ‍

We may ask you to confirm that suitable insurance has been arranged before issuing your final travel documents.

‍ ‍

Failure to obtain appropriate insurance may affect your rights if you need to cancel your holiday or incur additional costs during your trip.

‍ ‍

‍ ‍

12. Passports, Visas and Health Requirements

‍ ‍

It is the responsibility of every traveller to ensure they hold:

‍ ‍

  • a valid passport;

  • any required visas or travel authorisations;

  • vaccination certificates where applicable; and

  • any other documents required for entry into the countries being visited.

‍ ‍

Passport validity requirements vary between destinations and may change without notice. Many countries require passports to remain valid for at least six months after your planned return date.

‍ ‍

While Kukula Travel Ltd will provide general guidance whenever possible, the final responsibility for obtaining and carrying the correct documentation rests with you.

‍ ‍

If you are refused boarding, denied entry into a country or incur additional costs because you have failed to obtain the correct documentation, Kukula Travel Ltd cannot accept responsibility for those costs.

‍ ‍

Health advice and vaccination requirements may change at short notice. We recommend that you consult your GP, travel clinic or the appropriate government travel health advice well in advance of departure.

‍ ‍

Travel Documents

‍ ‍

Travel documents may be issued electronically.

‍ ‍

It is your responsibility to ensure that you receive, check and retain all travel documents before departure and to contact us promptly if you believe anything is missing or incorrect.

‍ ‍

‍ ‍

13. Special Requests and Medical Requirements

‍ ‍

We understand that every traveller is different and will always do our best to accommodate reasonable requests.

‍ ‍

If you have any special requirements, dietary needs, mobility considerations or medical conditions that may affect your holiday, please tell us before you make your booking or as early as possible afterwards.

‍ ‍

Where Kukula Travel Ltd is acting as your Travel Agent, we will pass your request to the relevant supplier but cannot guarantee that it can be accommodated.

‍ ‍

Where we are acting as Tour Organiser, we will work with our suppliers to make reasonable arrangements wherever possible.

‍ ‍

Confirmation that we have noted a request does not constitute a guarantee that it can be fulfilled unless we specifically confirm this in writing.

‍ ‍

If a traveller has a medical condition or disability that may affect the provision of travel services, it is important that we are informed before the booking is confirmed so that we can assess whether the holiday is suitable and discuss any reasonable adjustments that may be available.

‍ ‍

Our objective is always to ensure that every customer enjoys a safe and successful holiday.

‍ ‍

‍ ‍

14. Your Responsibilities While Travelling

‍ ‍

We ask all customers to behave responsibly and with consideration for fellow travellers, local communities, wildlife and the environment.

‍ ‍

You are responsible for complying with:

‍ ‍

  • local laws and regulations;

  • airline and transport provider requirements;

  • accommodation rules;

  • health and safety instructions;

  • guidance provided by guides, rangers and local representatives.

‍ ‍

Many of the destinations we feature involve wildlife, remote locations or outdoor activities where additional care is required.

‍ ‍

If your behaviour causes danger, serious disruption or significant inconvenience to other travellers, suppliers or local communities, the relevant supplier or Kukula Travel Ltd may require you to leave part or all of your holiday.

‍ ‍

In such circumstances no refund will normally be payable and you may be responsible for any additional costs incurred.

‍ ‍

‍ ‍

15. Flights, Flight Times and Transport

‍ ‍

All flight times, airline schedules and transport arrangements are subject to change. Flight schedules, routes and operating airlines are controlled by the relevant airline and may change after your booking has been confirmed.

‍ ‍

Airlines remain responsible for the operation of their flights and may alter schedules, aircraft types or departure times for operational reasons.

‍ ‍

Where Kukula Travel Ltd is acting as your Travel Agent, flight arrangements remain subject to the airline's Conditions of Carriage and any applicable ATOL holder's booking conditions.

‍ ‍

Where we are acting as Tour Organiser, we will notify you as soon as reasonably possible of any significant changes affecting your travel arrangements.

‍ ‍

We recommend that you do not make non-refundable onward travel arrangements, accommodation bookings or other commitments until your travel plans are finalised.

‍ ‍

‍ ‍

16. Wildlife, Activities and the Nature of Travel

‍ ‍

Many holidays arranged by Kukula Travel Ltd include opportunities to experience wildlife and participate in activities provided by local operators.

‍ ‍

For your safety, the instructions and guidance provided by guides, rangers, activity providers and local authorities must always be followed.

From time to time, activities or the order of an itinerary may need to be amended, postponed or cancelled due to:

‍ ‍

  • safety considerations;

  • weather conditions;

  • conservation requirements;

  • wildlife movements;

  • operational reasons; or

  • circumstances beyond our reasonable control.

‍ ‍

Where reasonably possible, we will arrange a suitable alternative.

‍ ‍

Where an alternative cannot be provided, any refund or compensation will be subject to the terms and conditions of the relevant supplier and the circumstances giving rise to the change.

17. Accommodation and Local Services

Accommodation featured within our holidays has been carefully selected based on its location, character, quality, authenticity and suitability for the experience offered.

Our portfolio includes a range of carefully selected accommodation, including:

  • owner-managed properties;

  • boutique hotels and lodges;

  • safari camps;

  • conservation organisations;

  • established safari operators; and

  • other specialist accommodation providers.

‍ ‍

Wherever possible, we choose to work with partners who share our values and make a positive contribution to local communities, conservation initiatives and the long-term sustainability of the destinations they operate within.

‍ ‍

Many of the properties we feature have their own distinctive style, atmosphere and character. Rather than offering a standardised hotel experience, they provide an opportunity to experience each destination in a way that reflects its environment, culture and heritage.

Accommodation standards, facilities and official grading systems vary considerably between countries and destinations and may not be directly comparable with those used within the United Kingdom.

‍ ‍

Descriptions, photographs and facilities are intended to provide an accurate representation of the accommodation at the time they are published. However, facilities and services may occasionally change due to maintenance, seasonal factors or circumstances beyond our reasonable control.

Where it becomes necessary to substitute accommodation forming part of a package holiday organised by Kukula Travel Ltd, we will use reasonable endeavours to provide accommodation of a comparable or higher standard wherever reasonably possible.

18. Complaints and Problems During Your Holiday

We want every customer to enjoy an exceptional holiday.

‍ ‍

If something goes wrong during your trip, it is important that you tell the relevant supplier, accommodation provider, guide or local representative immediately so that they have the opportunity to resolve the issue while you are travelling.

‍ ‍

If the matter cannot be resolved locally, please contact Kukula Travel Ltd as soon as reasonably possible.

Where we are acting as your Travel Agent, we will assist you in communicating with the relevant supplier wherever appropriate.

‍ ‍

Where we are acting as your Tour Organiser, we will work with our local partners to resolve the matter as quickly as possible.

‍ ‍

If you remain dissatisfied after returning home, please write to us within 28 days of the end of your holiday, providing full details together with any supporting documentation.

‍ ‍

Prompt notification gives us the best opportunity to investigate your concerns fairly and thoroughly.

‍ ‍

19. Our Responsibility to You

‍ ‍

Where Kukula Travel Ltd acts as your Tour Organiser, we accept responsibility for the proper performance of the travel services included within your package holiday, as required by the Package Travel and Linked Travel Arrangements Regulations 2018.

‍ ‍

If any travel service included within your package is not performed as agreed, we will take appropriate steps to resolve the issue wherever reasonably possible.

‍ ‍

Where Kukula Travel Ltd acts solely as your Travel Agent, our responsibility is limited to arranging your booking with reasonable care and skill. Responsibility for providing the travel services themselves rests with the relevant supplier or Tour Organiser with whom you have contracted.

‍ ‍

Nothing in these Booking Conditions limits or excludes any rights you have under applicable consumer protection legislation.

‍ ‍

‍ ‍

20. Circumstances Beyond Our Responsibility

‍ ‍

Kukula Travel Ltd cannot accept responsibility for loss, damage, delay or additional expense arising from:

‍ ‍

  • your failure to follow booking or travel instructions;

  • incomplete or inaccurate information supplied by you;

  • failure to obtain appropriate passports, visas or travel documentation;

  • events resulting from Unavoidable and Extraordinary Circumstances;

  • the actions or omissions of third parties unconnected with the travel services booked, where those actions could not reasonably have been foreseen or avoided.

Where difficulties arise during your holiday, we will always endeavour to provide reasonable assistance in accordance with our legal obligations.

‍ ‍

21. Limitation of Liability

‍ ‍

Where Kukula Travel Ltd is legally responsible for a claim, our liability will be determined in accordance with applicable law and, where relevant, any international conventions governing the travel services concerned, including those relating to carriage by air, sea, rail or road.

We shall not be liable for:

‍ ‍

  • losses that were not reasonably foreseeable at the time the booking was confirmed;

  • business losses;

  • loss of profit;

  • loss of business opportunity; or

  • indirect or consequential loss,

‍ ‍

except where such limitation is not permitted by law.

‍ ‍

Nothing within these Booking Conditions excludes or limits liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot legally be excluded.

22. Assistance During Your Holiday

‍ ‍

If you encounter difficulties during your holiday, Kukula Travel Ltd will provide appropriate assistance where required by law and wherever reasonably practicable.

‍ ‍

This may include:

‍ ‍

  • providing information about health services;

  • assisting you in locating local authorities or consular assistance;

  • helping you communicate with travel providers;

  • assisting with alternative travel arrangements where appropriate.

‍ ‍

We reserve the right to recover reasonable costs where difficulties have been caused intentionally or through the negligence of the traveller.

‍ ‍

23. Data Protection

Kukula Travel Ltd is committed to protecting your privacy and handling your personal information responsibly.

In order to arrange your holiday, we will need to collect and process personal information relating to you and members of your travelling party.

  • accommodation providers;

  • destination management companies;

  • guides;

  • transport providers;

  • insurers;

  • government authorities;

  • other travel suppliers involved in providing your holiday.

By making a booking, you confirm that you have the authority to provide personal information relating to all members of your travelling party.

24. Intellectual Property

Unless otherwise stated, all content produced by Kukula Travel Ltd, including itineraries, travel proposals, photographs, written material, branding and website content, remains the intellectual property of Kukula Travel Ltd or its licensors.

Our tailor-made itineraries are prepared specifically for our clients and may not be copied, reproduced or used for commercial purposes without our prior written permission.

25. Website and Marketing Information

‍ ‍

We take great care to ensure that the information contained on our website, itineraries and other marketing materials is accurate at the time of publication.

‍ ‍

However, accommodation, facilities, activities, transport schedules, prices and local services may change. Where we become aware of any significant change affecting your booking, we will notify you as soon as reasonably practicable.

‍ ‍

Photographs are intended to provide a general representation of destinations, accommodation and experiences. Seasonal conditions, refurbishment programmes and local circumstances may result in differences from those shown.

26. Governing Law and Jurisdiction

These Booking Conditions and any contract to which they apply shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute or claim arising out of or in connection with your booking shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws provide otherwise.

27. Severability

‍ ‍

If any provision of these Booking Conditions is found by a court or other competent authority to be unlawful, invalid or unenforceable, that provision shall be deemed severed from these Booking Conditions to the extent necessary. The remaining provisions shall continue in full force and effect.

28. Entire Agreement

‍ ‍

These Booking Conditions, together with your Booking Confirmation, itinerary and any documents specifically referred to within them, form the entire agreement between you and Kukula Travel Ltd in relation to your booking.

No variation to these Booking Conditions shall be binding unless agreed in writing by Kukula Travel Ltd.

‍ ‍

Nothing in this clause affects your statutory rights.

‍ ‍

29. Waiver

‍ ‍

If Kukula Travel Ltd chooses not to enforce any provision of these Booking Conditions on one occasion, this shall not prevent us from enforcing that provision, or any other provision, on any future occasion.
